FTC enforcement has slowed efforts to release a draft of Rep. Lee Terry's data breach bill. Terry has not able to get the consensus he'd hoped for. Republicans have historically strayed away from handing more controls to the FTC, which is pushing for more authority to combat the rising threat of data theft and malvertising. Democrats have tended to side with the FTC, although some insist any power shift does not weaken state laws. OTA is working to find a balance in proposed legislation, making it easier for business to navigate the mosaic of 46 state breach laws, while protecting businesses that adopt security best practices from legal action. OTA proposes a legal framework similar CAN-SPAM.
